Privacy Policy

SansAgent.ca (“we”, “us”, “our”) is committed to protecting your personal information. This Privacy Policy describes how we collect, use, disclose, and protect personal information in accordance with Québec’s Act respecting the protection of personal information in the private sector (RLRQ, c. P‑39.1), as amended by Law 25 (An Act to modernize legislative provisions as regards the protection of personal information).
1. Who We Are / Privacy Officer
SansAgent.ca operates exclusively in the province of Québec, Canada. Our designated Privacy Officer can be reached at: support@sansagent.ca
2. Personal Information We Collect
We collect the following categories of personal information:
- Account information: Name, email address, and hashed password when you register.
- Listing content: Property address, asking price, description, photos, and any other information you choose to include in a listing.
- Communications: Messages exchanged between buyers and sellers through the platform, and any emails you send us.
- Payment information: For paid features, billing details are collected and processed by our payment provider. We do not store full card numbers.
- Usage data: Browser type, pages visited, and interaction data collected through server logs and, where consented to, analytics tools. This data is aggregated and does not directly identify you.
We collect only the information that is necessary for the purposes described below.
3. Purposes of Collection
We use your personal information to:
- Create and manage your account;
- Publish and display your property listing;
- Facilitate communication between buyers and sellers;
- Process payments for optional paid features;
- Send transactional emails (account confirmation, listing updates, etc.);
- Improve and secure the platform;
- Comply with applicable legal obligations.
We will not use your personal information for any other purpose without your consent, unless required or permitted by law.
4. Consent
By creating an account and using the platform, you consent to the collection, use, and disclosure of your personal information as described in this Policy. Where we rely on your consent, you may withdraw it at any time by contacting us — though withdrawal may affect your ability to use certain features of the platform.
5. Disclosure of Personal Information
We do not sell your personal information. We may share it only in the following circumstances:
- With other users: Your listing information (property address, photos, description, price, and contact method) is publicly visible to anyone browsing the platform.
- Service providers: We work with trusted third parties (cloud hosting, payment processing, email delivery) who process personal information on our behalf under strict confidentiality agreements. These providers are prohibited from using your data for their own purposes.
- Legal requirements: We may disclose information when required by law, court order, or to protect the rights and safety of our users or the public.
6. Retention
We retain your personal information for as long as your account is active or as needed to fulfill the purposes described in this Policy. Account data is deleted within 90 days of account closure. Listing data is removed when the listing is deleted or the account is closed. Financial records may be retained longer to meet tax and accounting obligations.
7. Security
We implement appropriate technical and organizational measures to protect your personal information against unauthorized access, disclosure, loss, or alteration. Passwords are hashed using industry-standard cryptographic methods and are never stored in plain text. Access to personal data is limited to personnel who need it to perform their duties.
In the event of a confidentiality incident that presents a risk of serious injury, we will notify the Commission d'accès à l'information (CAI) and affected individuals as required under Law 25.
8. Cookies and Tracking
We use essential cookies required for the platform to function (session management, language preference). We do not use third-party advertising or tracking cookies without your explicit consent. You can control cookie settings through your browser.
9. Your Rights Under Québec Law
Under the Act respecting the protection of personal information, you have the right to:
- Access: Request a copy of the personal information we hold about you;
- Correction: Request correction of inaccurate or incomplete information;
- Portability: Request that we provide your information in a structured, commonly used format;
- Withdrawal of consent: Withdraw your consent to certain uses, subject to legal or contractual restrictions;
- Deletion: Request deletion of your personal information, subject to legal retention obligations.

If you believe your rights have not been respected, you may file a complaint with the Commission d'accès à l'information (CAI).
10. Automated Decision-Making
We do not currently make automated decisions that produce legal effects or significantly affect individuals based solely on automated processing of their personal information.
11. Changes to This Policy
We may update this Privacy Policy from time to time. We will notify registered users by email at least 30 days before material changes take effect. The updated Policy will be posted on this page with a revised effective date.
