Terms of Service

Welcome to SansAgent.ca. By creating an account or using our platform, you agree to these Terms of Service (“Terms”). Please read them carefully.

1. About SansAgent.ca

SansAgent.ca (“we”, “us”, “our”) is an online platform that allows homeowners in Québec to publish and promote their residential property listings directly to potential buyers — without the involvement of a licensed real estate broker. We operate solely in the province of Québec, Canada.

SansAgent.ca is not a real estate brokerage and does not act as one. We do not provide brokerage services, legal advice, or any form of representation for buyers or sellers. Transactions remain entirely between the parties involved.

2. Eligibility

To use SansAgent.ca, you must:

  • Be at least 18 years of age;
  • Be a natural person or a duly authorized representative of a legal entity;
  • Be the registered owner or authorized representative of any property you list; and
  • Provide accurate and complete information during registration.

3. User Accounts

You are responsible for maintaining the confidentiality of your login credentials. You must notify us immediately at legal@sansagent.ca if you suspect unauthorized access to your account. We are not liable for losses arising from unauthorized use of your account.

4. Listing Rules

When creating a listing, you agree that:

  • All information provided (description, price, photos, dimensions, condition, etc.) is accurate, complete, and not misleading;
  • You own the intellectual property rights to all photos and content you upload;
  • The property is located in Québec and is a residential property;
  • You will promptly update or remove the listing when the property is sold or withdrawn;
  • You will not use the platform to advertise properties on behalf of third parties for compensation unless you are duly licensed under the Real Estate Brokerage Act (RLRQ, c. C‑73.2).

5. Prohibited Conduct

You must not:

  • Post false, fraudulent, or misleading listings;
  • Harass, threaten, or discriminate against other users;
  • Violate the Charter of Human Rights and Freedoms (RLRQ, c. C‑12) in any communication or listing;
  • Attempt to circumvent our systems or access accounts that are not yours;
  • Use automated tools to scrape, index, or copy our listings without prior written consent;
  • Upload malicious code, viruses, or any content that could harm the platform or users.

We reserve the right to remove listings and suspend or terminate accounts that violate these rules, without prior notice.

6. Fees and Payments

Basic listing publication is currently free of charge. Optional paid features (such as featured placement or promoted listings) are described at the time of purchase. All prices are in Canadian dollars and include applicable taxes. Payments are processed securely through our payment provider. Fees for completed paid services are generally non-refundable unless required by law.

7. Intellectual Property

You retain ownership of the content you submit (photos, descriptions, etc.). By posting content on SansAgent.ca, you grant us a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute that content solely for the purpose of operating and promoting the platform. This licence ends when you remove the content or close your account.

All platform content, branding, software, and design elements are the property of SansAgent.ca or its licensors and may not be reproduced without permission.

8. Disclaimer of Warranties

The platform is provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee that listings are accurate, that the platform will be available without interruption, or that any transaction will be successfully completed.

SansAgent.ca does not verify the accuracy of listing information provided by sellers. Buyers are solely responsible for conducting their own due diligence, including engaging a notary (notaire) to review the transaction.

9. Limitation of Liability

To the maximum extent permitted by applicable law, SansAgent.ca shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform or any transaction between users. Our total liability for any claim shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Governing Law

These Terms are governed by the laws of the province of Québec and the federal laws of Canada applicable therein. Any dispute shall be subject to the exclusive jurisdiction of the courts of the province of Québec.

11. Amendments

We may update these Terms from time to time. We will notify registered users by email at least 30 days before material changes take effect. Continued use of the platform after the effective date constitutes acceptance of the revised Terms.
